First come, first serve in the .biz domain name registration

from:

Unlike any other domain name registration company, the .biz domain name is intended for use of legitimate and commercial businesses. And unlike other domain names, .biz domain name owners cannot sell their trademark to anyone or any company that has the same name.

Registering for a .biz domain name comprised of several stages. The first phase is usually when the registrar starts getting applications from different website owners. This is not the only thing that is included in the start up phase.

There is also what is called the Intellectual Property (IP) Claim Service that every owner should file for. Owners need to file for the IP Claim Service for their business or company to have its own trademark.

But applying for an IP does not guarantee that the chosen .biz domain name is already reserved to the ones who have selected them. It is also not an assurance that no other business or company will be able to acquire the same domain name trademark. Therefore, a single domain name can be filed by one or more companies on the same IP claim.

Filing for an IP in the .biz domain registration is for informational purposes only. The website owner who have filed the trademark will be notified early on in starting phase whenever someone else have filed an IP claim for the same domain name.

The next phase in the .biz domain name registration process is where duplicate name owners are able to file an appeal or a case against the other domain name owner. This is called as the Start Up Trademark Opposition Policy. This policy states that only when a website owner has proven that the replicate domain name is used improperly will the other application be put on hold.

The .biz domain name registration process makes it possible for the rightful owners to know if their names are being used by another. These owners are given the chance to oppose the registration because the domain name registration will be put on hold for a specific period of time.

During the time of the start up registration, when another owner is seen to be registering a name already used, the current owner will be notified of this matter. It can be noted that no domain name is ever approved during the start up phase because of the results that came up of the IP claims.

In this stage, domain names that have been registered first have to be processed. .biz domain names are also being given randomly. The decision is not based on who has gotten hold of it first or why.

Even if you try and register a domain name similar to other owners very well ahead of time, there is still no guarantee that you will be the one who will acquire that name. Owners need to wait for a certain period of time before they will know if ever their claims have been granted or not.

The recent changes to the .biz domain registration consists of the rule that whoever filed first will have the owner and trademark of the domain name that has been chosen.

That is why when you plan on applying for a .biz domain name, you need to consider filing first for an IP claim as early as the start up phase. If you feel that you should be the owner of a certain .biz domain name trademark, you need to know about the phases first and how they can work to your advantage.
